Terms of Service & Acceptable Use Policy (AUP)

These Terms and Conditions (“Terms”) govern the relationship between dqs hosting (“the Provider,” or “the Company”) and any individual or entity accessing or using our websites, platforms, products, or services (“Client,” “Customer,” “User,” or “you”).

Because our services are diverse, additional service-specific terms, policies, or guidelines may apply at various points throughout our platforms (“Additional Terms”). By using a service to which Additional Terms apply, you agree to comply with those terms in addition to these Terms.

dqs hosting aims to communicate information clearly and transparently. If you have any questions or require clarification regarding any part of these Terms, you are responsible for contacting our support team before continuing to use our services.

All Clients are required to use our services in a lawful manner. Users may be provided with or exposed to various forms of data, documentation, communication, and content (“Content”) in the course of using our services. You agree that your use of dqs hosting services and access to such Content will comply with all applicable laws and these Terms.

1. Eligibility

To access or use dqs hosting services, you must meet all of the following eligibility requirements. You may not use our services if:

• a) You are legally incapable of entering into binding contracts;
• b) Your account has been suspended or terminated by dqs hosting;
• c) You fail to provide accurate, complete, and up-to-date contact information, or we are unable to reasonably communicate with you;
• d) You are flagged by our fraud-prevention systems as presenting a high risk, or you fail to pass identity or payment-verification checks when requested.

dqs hosting reserves the right, at its sole discretion, to refuse registration, deny service, or terminate access for any individual or entity at any time, with or without notice.

2. Basic Provisions

These terms and conditions apply to all contracts and services concluded with dqs hosting. Unless otherwise agreed, the inclusion of any terms and conditions used by you is hereby rejected. You may not transfer, assign, or delegate any rights or obligations under these Terms without prior written consent from dqs hosting.

3. Conclusion of the Contract

We provide server hosting services. The scope of services is determined by the service package you have booked. The contract is concluded via our online shopping cart system. By submitting the order, you legally accept the offer, thereby concluding the contract. Order processing and transmission of necessary information are carried out partly automatically via email.

4. Service Provision and Obligations

• Server Administration: If we grant you administrative rights, you are solely responsible for the administration and security of your server. You must install necessary security software and independently close security vulnerabilities.
• Network Security: You must configure and manage your server so that the security, integrity, and availability of our networks and third-party systems are not jeopardized.
• Prohibited Activities: You are strictly prohibited from using our services for cryptocurrency mining, sending spam emails, operating open mail relays, or executing (D)DoS attacks. Any attempt to gain unauthorized access to our infrastructure, bypass security measures, or otherwise "hack" or spam our website, ticket system, or other dqs services is strictly forbidden. In case of violations, we reserve the right to disconnect the service without prior notice and terminate the contract. Such actions will result in a permanent block of your IP address, username, and in-game name (IGN) from all dqs services.
• Availability: We provide services with an availability of 99.9% on a monthly average, excluding planned maintenance or force majeure events. However, unexpected downtime can occur; while we typically provide compensation, we are not required to do so.

5. Further Obligations and Fair Use

• Account Information: You must inform us immediately of any changes to your data. Passwords must be kept strictly confidential.
• Resource Usage: During peak hours, you must maintain resource utilization (including heavy processes or plugins) within what dqs hosting deems "Fair Use" parameters. While we allow for greater resource flexibility during non-peak periods, you must ensure your server's activities never compromise the stability or performance of our shared infrastructure. Failure to maintain these standards during peak hours may result in temporary resource limitations or a temporary service shutdown to protect system integrity.
• Traffic and P2P: Traffic is strictly "fair use" as determined by dqs hosting. Operating P2P file-sharing networks, torrents, or similar file-sharing systems on the server is prohibited.
• Data Backup: Unless your hosting plan explicitly includes automatic remote backups, you are solely responsible for maintaining current backup copies of your data on separate storage. dqs hosting is not liable for data loss on plans that do not feature inclusive backup services.
• Storage Fair Use: All server storage is subject to our "Fair Use" policy. If a server's storage usage is deemed excessive or impacts overall system performance, we reserve the right to remove files (such as large logs, backups, or non-essential data) without further notice to bring the service back within fair use limits. While storage upgrades are available for purchase, all storage must be used for active service files and not for archival or mass-storage purposes.
• Designated Use: Services must only be used for their intended and designated purpose as specified in the purchased plan. If you wish to use your service for any purpose other than its designated use, you must seek prior written permission from dqs hosting. Any service found to be used for unauthorized purposes without explicit permission will be suspended immediately.

6. Content Moderation and Unlawful Content

• Prohibited Content: The distribution of terrorist content or unlawful content using our services is strictly prohibited. This includes materials that incite terrorism, provide instruction on weapon manufacturing, or violate trademark, competition, and data protection laws. Content that is racist, discriminatory, or glorifies violence is also strictly prohibited.
• Copyrighted Material: The hosting or distribution of copyrighted material without the explicit permission of the copyright holder is prohibited. If we suspect that a service is being used to host unauthorized copyrighted content, we reserve the right to suspend the service immediately for review. Services found to be in violation of copyright laws will be suspended or terminated.
• Enforcement: We are not obligated to proactively review your content. However, we reserve the right to access and review all server content, files, and metadata if we have a reasonable suspicion of a violation of these Terms. Upon discovering or receiving a valid report regarding legal violations, we are entitled to block the content, deactivate features of your service, suspend your account, or terminate the contract. For severe violations or where required by law, we reserve the right to report your IP address and account activities to the relevant local authorities. We will handle such reports with due diligence and proportionality.
• Third-Party Reports: We reserve the right to suspend or terminate your service if we receive a report from a third party or authority indicating that your service is being used for activities that, in our sole judgment, are improper, harmful, or constitute "not good use," regardless of whether such activity is explicitly prohibited elsewhere in these Terms.

7. Contract Term and Termination

• Prepaid Billing: All services are strictly prepaid. To maintain active service, renewal payments must be received within the designated billing period (e.g., monthly). Failure to provide a renewal payment by the due date will result in the automatic termination of the service.
• Data Retention & Non-Payment: After a service expires due to non-payment, we reserve the right to immediately delete all associated server data and files without further notice. dqs hosting is not liable for any data loss, service interruption, or downtime caused by the deletion of expired or unpaid services.
• Termination for Cause: We have the right to terminate the contract without notice in the event of repeated breaches of your obligations (including AUP violations, DDoS, spam, illegal content). Any attempt to defraud the company will result in your IP address, username, and other network identifiers being permanently blocked from all dqs services.
• Discretionary Suspension and Deletion: dqs hosting reserves the absolute right to suspend, terminate, or permanently delete any server, data, and account at any time, without prior notice and without eligibility for a refund. While we strive not to suspend services without a clear reason, we reserve this right to act at our sole discretion when we determine it is necessary for the security, integrity, or well-being of our platform and its users.

8. Changes to these Terms of Service

dqs hosting may modify, update, or replace these Terms at any time. Unless otherwise required by law, changes will take effect immediately upon being posted on our website or communicated through the billing panel or control panel. dqs hosting is not required to provide individual or direct notice of changes to any User.

Your continued access to or use of our services after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the services.

9. Indemnification

You agree to indemnify, defend, and hold harmless dqs hosting, its parent entities, subsidiaries, affiliates, directors, officers, employees, contractors, suppliers, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use or misuse of the Services, breach of these Terms, violation of any law, or any content perform under your account.

10. Feedback and Reviews

Users are encouraged to provide honest feedback and reviews regarding their experience with dqs hosting. We strive to continuously improve our services based on user input. We do not remove reviews, but we politely request that all reviews be based on an actual, verifiable experience using our services. Please note that posting false or fabricated reviews is harmful to our community and our team—we put a lot of heart into our work, and dishonest feedback makes us quite sad. Writing a false review wont be removed at all, we are against removal of reviews. but just dont do so...
